By accessing and using Caplira ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Caplira provides a cloud-based skills assessment platform that enables organizations to create, distribute, and evaluate candidate assessments. The Service includes features for assessment creation, candidate management, automated grading, and analytics.
3.1 Registration: You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Usage: Accounts are intended for business use only. You may not share your account with others or allow unauthorized access.
4.1 Free Trial: New users receive a 7-day free trial with up to 10 candidate assessments. No credit card is required for the trial period.
4.2 Paid Plans: After the trial period, continued use requires a paid subscription. Plans are billed monthly based on the number of candidates tested.
4.3 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
4.4 Refunds: We do not provide refunds for partial months of service. All charges are non-refundable except where required by law.
You agree not to:
6.1 Ownership: The Service, including all content, features, and functionality, is owned by Caplira and is protected by international copyright, trademark, and other intellectual property laws.
6.2 User Content: You retain ownership of content you create (assessments, questions, branding). By using the Service, you grant us a license to host, store, and process your content to provide the Service.
6.3 Question Templates: Pre-built question templates provided by Caplira remain our intellectual property.
Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy, which is incorporated into these Terms by reference.
We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPLIRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms or for any other reason at our sole discretion.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Caplira operates, without regard to its conflict of law provisions.
